Wherever an Islamic Judicial system exists, Muslim women could approach an Islamic court to seek an annulment of their marriages. In the absence of such a system, as is the current situation in South Africa, women have an alternative to approach a Judicial Tribunal for annulment.
A Judicial Tribunal should comprise of religious and competent individuals of integrity. An annulment concluded by such a tribunal, based on Shar'i procedures and grounds, is valid and binding upon the couple, resulting in the wife being released from the marriage.
The Muslim Marriages Tribunal, an initiative of Darul Ihsan Centre, has been established to serve the Muslim community in realising the above objectives.
